A Pasco County landowner's guide

Selling Inherited Land in Pasco County, Florida

Last updated October 27, 2026.

Find the estate records, confirm who can act, and research the parcel separately. Pasco County probate is filed with the Clerk at one of two judicial centers and heard in the Sixth Judicial Circuit, and the land questions depend on whether the parcel is in a city or unincorporated.

Start with the Florida inherited-land guide for statewide ownership, probate and tax questions. This page covers Pasco County's local records and contacts. An estate can involve both court work and land-use research; completing one does not settle the other. If you are weighing a sale, see selling land in Pasco County.

1. Connect the deed to the Pasco parcel record

Find the parcel ID on a deed, tax notice or estate inventory, then search it in the Property Appraiser's records search. You can also search by owner name or by the official record book and page of the deed, which helps when the family only has a recorded deed copy.

Compare the owner shown there with the decedent. A deed from an earlier generation that was never updated is a common reason title takes longer.

2. Pasco County probate and the Sixth Judicial Circuit

The Clerk's Probate/Estates page says a petition for probate may be filed when a person leaves titled assets in his or her name alone, and that the Court oversees the estate to see that debts are paid and distribution is proper. It lists two locations: the Robert D. Sumner Judicial Center, 38053 Live Oak Avenue, Suite 207, Dade City, (352) 521-4542, and the West Pasco Judicial Center, 7530 Little Road, Suite 105, New Port Richey. Pasco is in the Sixth Judicial Circuit, which it shares with Pinellas.

Attorney requirement

The same page says every personal representative, unless he or she is the sole interested person, must be represented by a Florida attorney under Probate Rule 5.030. Plan for legal help early.

Venue

Florida's venue statute starts with the decedent's Florida domicile, so owning Pasco land does not by itself make Pasco the venue. Confirm with your attorney.

3. Confirm which documents establish sale authority

For land, authority usually comes from letters of administration, an order of summary administration that distributes the parcel, or a chain of title already in the heirs' names. A tax-roll name or death certificate does not allow anyone to sign a deed.

Wills are placed on deposit with the Clerk only after the person has died, and some estate documents are confidential by statute, so not every file will be open to view. Ask your attorney to obtain what you need.

4. Research the land while the estate questions are being answered

Zoning

The county's Land Development Code governs unincorporated parcels, and county GIS data includes zoning district polygons for those areas. Confirm the jurisdiction first, because cities inside Pasco have their own rules.

Flood information

Run the address through Find My Flood Zone for current zone and base flood elevation, and use FEMA's Map Service Center as the federal source. Do not rely on a map copied into the estate papers.

Wetlands

The Southwest Florida Water Management District permits wetland impacts. Before setting a price expectation, learn whether any part of the land is wetland.

Liens, access and costs

Unpaid taxes and recorded liens can attach to vacant land. Add carrying costs to any decision about keeping it.

5. Choose a next step without rushing the estate

Heirs can keep the land, list it, or explore a direct sale once authority to sign is clear. Holding costs taxes and upkeep, listing costs commission and time, and a direct sale can mean a lower price in exchange for a simpler closing.

If a direct sale fits, Abundant Land Group can review the parcel and discuss a written offer while your attorney handles the estate. An offer does not bypass probate or settle who must sign, and not every parcel qualifies. We cannot give legal advice. For the land side, see selling Pasco County land.

Questions to bring to your attorney

  • Which probate proceeding fits this estate, and is Pasco County the proper venue?
  • Do the heirs need a Florida attorney under Rule 5.030, and who will serve as personal representative?
  • Is the parcel homestead property, and how does that change who must sign?
  • Is the parcel in a city or unincorporated Pasco, and whose zoning applies?
  • What is the current flood zone, and does any part of the parcel hold wetland?
